To Whom It May Concern

Please be advised that your letter to Equality for Flatbush (E4F) was sent out to our
organizational base of 1000 + tenant leaders, housing rights , Black Lives Matter,
police accountability and anti-gentrification activists across New York City.
Also Please Be Advised:

1. Your letter according to NYS Housing Law is evidence of interfering with the
ability of the tenants and shareholders of 3400 Snyder, 3500 Snyder, 282 E 35th St,
& 285 E 35th St, to organize in their own best interest . By law, residents have every
right to meet in common areas for both shareholder or tenants meetings . That
you stated, “If necessary, the cooperative will seek a preliminary injunction
against your organization to prevent it from illegally entering or using the lobby
or any other part of the building for meetings”, is further proof of impeding the
rights of residents to invite tenants rights organizers and lawyers to aid them in their
organizing.

2. No Equality for Flatbush, staff or organizers, has been involved in any flyering or
postering of 3400 Snyder, 3500 Snyder, 282 E 35th St, & 285 E 35th St. Both the
creation of the flyer and its distribution was done solely by both tenants and
shareholder leaders.

3. For several months , Equality for Flatbush has received numerous complaints by
both shareholders and tenants , about the lack of repairs, the lack of mold removal ,
damages due to leaks , as well as accusations of both racial and sexual harassment by
Maxx Properties employees. Furthermore, given the current HPD violations and
national online complaints against Maxx Properties, Equality for Flatbush was then
invited by both tenants and shareholders to host a meeting for all 3400 Snyder,
3500 Snyder, 282 E 35th St, & 285 E 35th St residents.

4. There is absolutely no NYC COVID requirement for proof of vaccination to enter
private residential buildings. Not even the use of masks can be enforced in residential
buildings in NYC. According to the tenant and shareholder leaders, there are several
units that do not require entering a lobby to gain access. As of January 26, 2022,
there are no public signs posted in the lobbies of 3400 Snyder, 3500 Snyder, 282 E
35th St, & 285 E 35th St. requiring proof of vaccination, which would be in
violation of NYC COVID requirements.

5. All of the shareholder and tenant leaders of 3400 Snyder, 3500 Snyder, 282 E 35th
St, & 285 E 35th St. have been sent your letter and have decided to exercise their
right to organize a meeting in the common area of 3400 Synder on January 27, 2022,
in accordance to NYS Housing Law which is protected by the US Constitution.

6. Lastly, as a nationally recognized Black Lives Matter organization, we find your use
of the term, “trespass” and threatening to “seek a preliminary injunction against
your organization to prevent it from illegally entering or using the lobby or any
other part of the building for meetings involving numerous people that will
disrupt the life, peace, and safety of the residents of the property” not only a
form of Anti-Black racism but also as a threat of violence.
